Nursing Home or Community Residential Care Facility Licenses
S.C. Code 44-7-264 provides that to obtain a license to operate a nursing home or a community residential care facility, the person, or persons, required to sign the licensure application are required to undergo a state and national fingerprint-based criminal records check. Further, that section provides that a license must not be issued to an applicant, and if issued, may be revoked, if the person or any one person required to undergo the check is required to register under the sex offender registry or has been convicted of:
- Abuse, neglect, or exploitation of a child or vulnerable adult, as defined in Section 43-35-10;
- Any violent crime, as defined in Section 16-1-60;
- Any other drug related felony;
- Forgery, embezzlement, or breach of trust with fraudulent intent, as classified in Section 16-1-90(E); or
- A criminal offense similar in nature to the crimes listed in this subsection committed in another jurisdiction or under federal law.

Important Information
For those undergoing a background check for nursing home or community residential care facility licensure, please note the following instructions:
- Please submit the licensure application prior to undergoing the fingerprint-based checks.
- HQ staff will provide those undergoing the check with the following notices and the service code for having your fingerprints taken at an approved vendor:
- Finally, those undergoing checks are notified that they may challenge the accuracy or completeness of any entry on his/her criminal history record.
- The subject of an out-of-state record may direct his/her challenge as to the accuracy or completeness for an entry on his/her record to the Federal Bureau of Investigation (FBI), Criminal Justice Information Services (CJIS) Division, ATTN: SCU, Mod. D-2, 1000 Custer Hollow Road, Clarksburg, WV, 26306. Visit the FBI Website for more details.
- For an in-state record, the subject may contact SLED directly at (803) 737-9000 or visit sled.sc.gov/cjis. The subject should be prepared at that time to provide their full name, date of birth, social security number, and the reason behind the challenge or correction request.
- Please note that, pursuant to the directive of SLED, if HQ personnel receive CHRI that is not connected to a known licensure applicant, we will immediately destroy such results and notify the SLED NJIS Unit.
