Important DPH Regulations Update

All DPH regulations are being updated for DPH references and to reflect the move from Chapter 61 to new Chapter 60 in the S.C. Code of Regulations.

Updates to DPH Regulations

On May 23, 2025, State Register Document No. 5352 became effective upon publication in the South Carolina State Register. Document No. 5352 includes the technical changes to DPH regulatory text that were needed as a result of 2023 Act No. 60 (S.399, DHEC restructuring).
Key technical changes to the regulations include:

  • Transfer of 39 DPH regulations from Chapter 61 to the new Chapter 60 of the S.C. Code of Regulations. While the regulation chapter number has changed, the rest of the regulation number remains unchanged (e.g., Regulation 61-13 is now Regulation 60-13).
  • Updates to DHEC references, including definitions, acronyms, email addresses, physical addresses, and other references (e.g., DHEC changed to DPH).

DPH is updating the regulation PDFs and other references on the website and expects to have the updates completed soon. In the meantime, please refer to Document No. 5352 for the full list of technical amendments.

Additionally, Regulation 60-13 (formerly 61-13), Intermediate Care Facilities for Individuals with Intellectual Disabilities, was substantively revised through State Register Document No. 5347, which also became effective on May 23, 2025.
